If I don't agree with the condemning authority's offer, who decides how much money I get?

In Virginia, state law allows the landowner to elect either a jury or a panel of five (5) commissioners to determine the amount of compensation to be paid to the owner who loses his or her property through condemnation. The jury panel must consist of a majority of landowners. Commissioners must all own property and reside in the jurisdiction of the taking. The jury or commissioners determine the amount of the award, which may include damages.

 

Whether you choose a randomly selected jury or a panel of appointed commissioners is a tactical decision that you should make in consultation with your attorney.
